Judge delays hearing on Massey permit

U.S. District Judge Robert C. Chambers has extended his temporary restraining order blocking a Massey Energy mining permit for more than two months, and rescheduled a hearing on whether to grant an even longer-term injunction.

The case concerns a new permit for Massey subsidiary Highland Mining’s Reylas Surface Mine in Logan County, W.Va.

Chambers extended his TRO until June 3, and set a preliminary injunction hearing for May 10. Both parties apparently agreed to the delay, according to court records.

A preliminary injunction hearing had been scheduled for next Tuesday in Huntington.
